The Juvenile Justice System Focuses On Rehabilitation

In most cases, charges brought against a child are handled in the juvenile justice system in Florida. There are similarities between juvenile and adult criminal court, including due process rights and the requirement to prove guilt beyond a reasonable doubt.

There are also some differences between the two justice systems. One primary difference is that a judge both presides over the case and issues the verdict, not a jury. Another primary difference is that the penalties are focused less on punishment and more on rehabilitation.

A juvenile who is an adjudicated delinquent may be required to:

  • Complete a period of probation
  • Pay restitution for damages
  • Participate in community service
  • Abide by a curfew
  • Submit to drug and alcohol testing
  • Have his or her driver's license suspended or revoked
  • Enter a substance abuse treatment, school or other program

Although most cases involving a minor are handled in juvenile court, a child could still face prosecution as an adult in criminal court.
